I have a friend that currently lives in Fla. His father died and left him his home in Virginia. He now has to pay the mortgage on the home in Virginia and his rent in florida. There is a man living in the home in virginia for free because his Sister told him that the house has to be Occupied otherwise the state can take the house away....

It sounds like a bunch of crap to me. but maybe someone elses knows the truth.

Absolute crap, you can let your house stand open for years. I mean, what if I went on an extended vacation? I think someone lied in order to get someone else free rent.

that is bogus. what about vacation homes. If i have a home at the beach, i don't have to get someone to live in it until i go on vacation. most localities require a house be MAINTAINED. the grass must be mowed, sidewalk shoveled when it snows, etc. My guess is that the sister is sleeping with teh deadbeat. as lond as teh house looks presentable, call it a vacation home, and its no problem.

your friend now legally owns the home? No one can live there without his permission, but here is the key...Your friend needs to go evict him immediately. As ridiculous as it sounds, there is something called SQUATTERS RIGHTS.... long story short, have your friend go evict him and then hire a security company to overlook the home in his absence or buy a security system if he is really cheap.
GOOD LUCK

Well your gut feeling is right.
Here is where you need to go and do your research:
LAWS: http://leg1.state.va.us/000/src.htm
STATE’S WEB SITE: http://www.virginia.gov/cmsportal2/
LANDLORD TENANT ACT: http://www.vdacs.virginia.gov/consumers/f-landlord.html
Cities Web sites: http://www.naco.org/Template.cfm?Section=Data_and_Demographics&Template=/cffiles/counties/citiesstateall.cfm&STATECODE=VA
Probate (Title 64.1): http://legis.state.va.us/Laws/CodeofVa.htm
State bar Association: http://www.vba.org/
Send him those links and let him find out for himself that his sister might of misunderstood some advice she got. Maybe the man living there is your friend's sister's advisor.

That's bs. Even if it were true, he could always find someone to PAY to live there.

The house has to be MAINTAINED, though.
