I filed Bankruptcy this month and one of our credit cards we had jointly. I am clear of the debt and now they are sending him the bill. Even though he deserves everything thats coming his way I still feel bad that now the debt is totally his (I took nothing in the divorce) but I can't afford to pay it. Has anyone experienced this and what, if anything, can be done to clear it up or no matter what he will have to pay it???

He is just as responsible for the account as you are. When you both signed for the card, you both agreed to take responsibility for the debt. The only catch for him is now that you are under court protection from collection, he is solely responsible for the paying the debt. He will have to pay the bill!

You can't feel bad for doing what was best for you. Keep in mind that things happen for a reason and move on from here.

He'll get over the shock of an extra payment and you can work on getting your finances in order.

First of all, responsibility for this debt should have been covered in the divorce order. You might have a court order stating who is responsible for paying this debt.

You both signed on the card and both agreed to be responsible. Your ex is stuck with this debt, but you may owe him if the divorce order assigned the debt to you. Your ex can always file his own bankruptcy.

Yeah i am sorry to say that you and your ex signed a contract saying that you both would be responsible for the charges, and if you declaire bankruptcy then they are going after the other signer on the account. basically the debt is his. lets say you wanted to get a loan on a car, but your credit wasn't good enough so i cosign the loan for you. well if for some reason you don't pay the bill they would come after me for the money, even if you didn't declair bankruptcy, my name would still be on that loan. i would go to your local legal aid office, they can offer you advise on what to do. i'm sorry to hear you are having so much trouble, good luck with your money problems i hope they clear up for you.

The debt was joint and he didn't file, so its his debt. He can file for bankruptcy or pay it. It would be the same if it was a house or car.

Yes, I was in the same situation as you. My ex worked out a payoff amount with the creditor, so your ex won't get stuck paying the whole thing. Probably just his half. He needs to call the creditor/collection agency though and negotiate, if he lets them take him to court, they will be more agressive.

He will have to enter as notice of dissassociation-but for this to be affective you can't have any outstanding joint accounts, one of you will need to pay it! if he messes this up it will appear on your credit report!

If the card is/was in his name he is on the hook.
