Im not sure if I put this in the right catagory, but here it goes.....My ex and I were evicted for an apartment 2 years ago. I am in the process of fixing my credit so Im going to have to pay off the remaining balance of the lease. Can I pay this in full then sue him for half since both of our names were on the lease????Please help!

If he broke a legal agreement that he signed then yes. Who ever has his or her name on the lease is the responsible party. I would still consult with legal counselor on this issue.

Yes, you can since both of your names were on the lease. Be sure you have a copy of the lease showing both of your names. Have any supporting documents that show when you moved. Also, have any receipts showing that you paid. Then go to your County Courthouse-see a magistrate and fill out a form for a suit in small claims court. One final thing, most small claims courts have limits on how much a person can sue for. (Like 2,000, 3,000 or 5,000. So, you may not get all of the money you deserve. Sucks, but that's the way it is. Of course, your court could have a high limit.

Since you were both on the lease you are both responsible.

Contact the Tenants Union in your area to get info on your rights as a tenant. You should also contact an attorney for advice to make sure that you can sue him for the other half.

I had a similar situation with bills, not eviction, with my ex several years ago. Since I was the only one attempting to pay, the bill collectors were only coming after me. I could have sued him, but I could not find him and I gave up.

Don't give up if you can sue the bastard:)

I would say yes. Was his name on the lease also? Thats the only way i think you would be able to sue him. He is responsible for half of the rent too. I would call a lawyer and go for a free consultation.

I think it is difficult. There is nothing written there that says you pay half and he pays half. You were both on the lease, but, it didn't matter who paid. If you can prove he was supposed to pay half and failed to do so after being asked, you may want to try suing him in the small claim court. My guess is you probably won't get the money.

You CAN sue anyone for most anything. Whether you've got a chance of collecting is another thing and, if you do collect, whether the recovery is worth the cost is still another.
In the future, don't do business (even the personal kind) with deadbeats--but you already know that, right?

most likely yes you can just be sure to have all your info like the lease and receipts etc. you can probably go to your court house and ask them what you have to do. I guess it would be handled in small claims court.
