I went into a local walk in clinic where i told them i was having a sharp pain when i breathed. They did some stuff and told me it was probrobly just a pulled muscle and to call if it got worse. I had to make them do an x ray b/c they thought it wasnt serious but i knew i was in a lot of pain. So in the next week the sharp pain got worse and i called them and they said the doctor would call me back. Never got a call back and about 2 weeks later bairly being able to walk i went to the emergency room where i was told i had the worse case of phnemonia they had seen in ten years and had surgery and now have a scar larger then a ruler on my right side of my back and had to get a blood transfusion during surgery.

Probably not.

I have seen a case of pneumonia which developed over the course of 12-24 hours. The patient was initially seen by a colleague of mine and discharged home with a diagnosis of viral chest infection.

The patient deteriorated and came back to hospital at which time I saw him.

He was a young man in his 30's - usually fit and well. He had obvious signs of pneumonia, his X-ray showed pneumonia and his lab tests were in keeping with pneumonia.

We admitted him to hospital and gave him antibiotics and he recovered.

Because we were concerned that we should have picked it up the first time he came, we reviewed his x-rays and lab tests with independent specialists. His first lot of x-rays showed no pneumonia and his first lot of lab tests were compatible with a viral illness. If I was in my colleague's shoes, I would have sent him home with a viral chest infection and the scrutiny would have been on me.

Most likely, they would ask you - why did you wait 2 weeks before returning to the Emergency Room? It is well known that patients can deteriorate, particularly patients with chest pains on breathing can UNDER-breathe and cause a pneumonia (which might or might not have been present to begin with).

Nonetheless, you don't know unless you ask. You'll really want to ask a lawyer about this. Not us people here on yahoo answers (unless a lawyer happens by).

Go to a sharp malpractice lawyer - his medical experts will demand from the walkin clinic to forward the X-ray films, lab reports, & entire file on you. The MD consultants will review all data and determine if they negligently missed correct diagnosis. Your attorney then will decide if grounds for lawsuit. If he says yes, then go for their throats.

Talk to a lawyer. Sounds like you could have a case. If the lawyer agrees, they will take your case for no money up front---their money would come out of your settlement.

you can't blame the walk-in clinic. they gave their opinion, but if you thought it wasn't right, it is your prerogative to seek a second opinion. malpractice cases for example are when the surgery goes wrong like they left an instrument in ur body or something crazy like that.

you have certainly been subjected to a case of bad physicianship... :)

if there is a legal case in there somewhere depends on yor local laws... but in my country the chances would be slim, at best. still... if you have leagal insurance, talk to a lawyer... you never know

best to talk to a lawyer who deals with medical cases, i would suggest sending a letter of complaint aswell to the clinic who treated you, to get the ball rolling
