I worked for a company for which i had 25 days holiday a year (Jan 01 - Dec 31) which equates to 2.083 days a month. I left on Sept 30 after handing my notice in on Aug 30, they are saying that I only accrued 8 x 2.083 days holiday and have paid me accordingly (minus the holiday that I have took) whereas I think that I should be entitled to 9 x 2.083 days holiday as I was there from Jan 1 and worked 9 full months! What does employment law say about this?

+ You would have to check with your employer's company rules. There is no law that says that any company must pay you for any holidays. (time not worked)
There is a law that states that if they pay any employee's for holidays they must pay all of them. (with the exception of certain management positions who generally get more than anyone else)
If they did the same for all others in your group they are correct, if they did it differently for some then you have a chance.
If you are on active service for the military during this period you may get assistance, and your employer may owe you three years pay whether you work it or not.
It sounds like you are arguing over one day's pay? I think you might be better off mentally to just move on, unless you have a union or attorney that will help with your case.

Yes you should still accrue the holiday entitlement. Your employment ceased on your termination day i.e. the last day of employment, not the day you handed your notic in.

Unless your contract of employment stated otherwise, you are entitled to holidays for every month you work there, whether you were working your notice or not.

Contact your local Citizens' Advice Bureau for assistance.
