Not if the place of employment is an equal opportunity employer.

However, that doesn't mean you can't be discriminated against.

But it depends on the job, honestly, such as a wheelchaired person probably shouldn't apply for a job that requires loading 70+ lbs of furniture into someones vehicle, or some such. And while the person didn't hire you because you were overweight, chances are that a better candidate applied.

Think of it more like, "you weren't rejected because you are overweight, you just weren't hired because of it"

You can get turned down for a job for anything. It doesn't matter as long as they don't tell you. Then it would be grounds for a lawsuit. I know I don't get some jobs because I am freakilehly tall and guys don't like girls who are taller (they get intimidated). I know I have been qualified for a job but somehow someone else gets it who is less qualified....HMMMM Sounds like insecurity on the hiring dept. Just keep looking youll find one.

really depends what job.
some jobs really demand for a certain weight level -- but for the simple reason of providing optimum service to clients or to its very industry.

athletes. stewardesses (you should know how narrow the aisles are in economy!). most modeling agencies (though there are those who cater to heavier models). lifeguards and the police force (there's a limit, and you have to be able to run real fast too). most health establishments have to project physically fit employee image. and the like.

general rule, though, if you can do the job, you shouldn't be prejudiced against.

best rule, stay fit.

It probably depends on the job and what it entails. There are certain jobs that only certain people can do. Obviously a person in a wheelchair can't do construction work on steel towers.

You may not get turned down for being overweight, but you may for using your instead of you're.

People are unknowingly (or knowingly) hired based on their looks everyday. Title VII does not protect the obese. Discrimination is legal, though unethical. If someone's weight prevents them from fully performing one's duties, then it becomes a performance issue.

Just look at the cocktail waitresses Vegas. They used to be gorgeous and now most of them are fat pigs. Any employer should be able to not hire someone for any reason, including this.

Yes, but they can't tell you that is the reason because that would be illegal - unless the job requires a weight limit.

I don't know that appearance is a protected category. If you are obese and if that is considered a disability, then it is protected. If you are just a little heavy, then they probably can. As one person put it, you have to be able to do the job.

Good luck!
