After delivery I checked the doorways for damage, did not see any, and signed the waiver. That night my wife discovered gouges in my brand new linoleum floor. I called right away, but Sears says because I signed waiver they aren't liable, and refuse to take responsibility. Any suggestions??

When someone makes a reply that doesn't make sense I always ask them who their supervisor is, and speak to him/her. I keep doing that until I get the answer I want.

Also, I write a letter to the CEO, Store Manager, Department of Consumer Affairs, Consumer Reports, and anyone else I can scare them by contacting.

P.S. You can bluff by using cc: all those people, but not really send the letter.

The first thing you should do is attempt to talk to the store's General Manager. If they can do nothing for you, call Sears' National Customer Relations number: 800-549-4505, and ask to speak to higher-ups as necessary. Hopefully they will be able to reasonably compensate you. It will be difficult to do without proof, but I've learned that enough complaining will get you anywhere.

Contact Sears again .........talk to a superviser......it is common to miss stuff not obvious......if you don't get help.....contact the Better Business Bureau! Good Luck......it would help if in the future you take before pics of area before service people enter your home this way you have proof of sorts ! Good Luck....remember don't swear but don't be too nice !

All it'll take is a settlement letter sent by an attorney. Find one, make sure she doesn't charge you more than 200 bucks, and have her send a letter demanding full payment for the damage. They'll take care of it. Make sure you take photos of the floor. Good luck!
