I have a friend and he recently found out his girlfriend is pregnant. They were both ecstatic as first but then she decides he will not be on the birth certificate or ever see the child. She doesn't even want him there for the birth. They broke up because he was smothering her. Any way he's very upset but does not know what to do. Will he have to spend a lot of money and lawyer up to get a paternity test? If so then what are his chances of getting the child's name changed and getting joint custody? He lives in Kentucky.

Well, he will have to hire an attorney to file for the paternity test with the courts. The Judge will order a hearing requiring both parents to be there. If he is indeed found to be the biological father, then he can have his lawyer petition the court for joint custody and will stand a very good chance (85-99%) of getting just that.

SHE cannot decide these things, as the father has paternal rights. Yes, a paternity test will indeed be necessary but it isn't that much money. He will also be responsible for child support money until the child is 18 years-old. He should retain a lawyer regardless of his financial status.

I don't think there is any way she can legally keep his name off the birth certificate if he wants it on there. What name is she going to put down as the father? Stork? Someone has to be the father, and even if she lists ME, a celebrity, he could contest it and have a DNA test done to prove paternity and have My name taken off and his put on. She is kidding herself if she thinks otherwise.

Why anyone would want an idiot moron like me as the father is beyond me, but you never know.

He needs to see a father's rights attorney. The Mom can not keep him from his child, however, he should be aware that he will have to pay child support if he claims it.

Under Australian Law - forget it. This happened to me 19 years ago and - to this day, my son and I have never seen each other.
