In reality, it's happened once. During the Civil War, the western counties of Virginia broke away for Virginia to form West Virginia.
Economically, it was probably a bad move over the years. Today, WV is ranked always in the lower % of things. Whereas, had they stayed connected to Virginia, they could have benefited with that association with the proporous Eastern Virginia. California has considered spliting for years, but it will probably never happen.

Texas can split up into 5 states if it chooses. That would be legal. They just cannot secede from the union.

They should file the proper petition with the concerned departments of the government. Referendum is required and let the citizenry decide, whether they like it or not.
