I live in florida, I am an exempt salary employee. If I do not work 80 hours in a given pay period, can my employer dock my pay? I worked every day in those pay periods (no sick days). They were just shorter weeks. When I go over the 80 hours I do not receive overtime. What is the point of being salary, if it is only benefiting the employer! If this is not supposed to be happening what recourse do I have to recover the lost pay?

If you're salary, you can be expected to work a lot of hours... but they can't touch your salary unless you have gone through due process to explain why your salary is being reduced. Legally, it can NOT be by your hours... however, they won't be that stupid... they'll indicate it's work performance or something else. Stand your ground and find out exactly what they mean... if they're smart, they'll have documentation to show you. If they're stupid, they're asking for a lawsuit.

They can dock your pay, it is part of the agreement. A federal law. There is some sort of statute on it, I am not sure, but you should have some paperwork about transitioning to salary.
