i would never hurt my kids by using them to get back at their father my children come first he only wants to hurt me by takin them he n his girlfriend told my grand mother they didnt want no d*** kids so y take mine besides to hurt me all women aint b****** like a lot of u bitter divorced men think give some a chance to prove you wrong.......... I dont have a lawyer im doing this myself so all my time and money can go for bills needs and wants for my kids....... now what do you think my chances r?

Kim, As long as he can't prove you unfit you will win in court. Call your legal aide in the town you live in and see if they can't help you. If your doing it on your own please be careful as these lawyers are trained. Have a talk with him and find out what the problem is and why does he think his girlfriend would want the kids. If he refuses to talk with you keep a record of all the times you have tried to discuss the kids with him. This will only help you to prove to the judge he isn't willing to put the kids best interest above anything else.

Go to family court and ask about getting a free lawyer. It's based on whoever gets there first to ask (Dad or Mom?)...at least that's how it is here in Canada. Anyways, start by doing that...it can't hurt to ask.

Unless he can prove you an unfit mother, then his chances are pretty slim of getting custody. You could go for joint custody but with the kids living primarily under your roof. The amount of time Dad sees the kids can depend on lots of things such as the proximity of his residence to yours. I know families where the kids lived with both parents equally, alternating weekly. The usual norm though is every 2nd weekend and maybe a few extra days during holidays/vacations. You and your husband need to work this out and decide what is in the best interests of the children.
