I had a similar experience so what I did was got an account with Washington Mutual because you only have to keep five dollars in your account to keep it permanent and open. Now I pay all the bills by money orders now. Its a little more troublesome but I never ever had to pay an overdraft change again! That ceased the minute I started paying bills by MO. May I suggest the same thing. Do as little as possible through your account. You would think you can't live without it but you can. I only put money in the account when I want to buy something on line and that's it! The day I started making this change, is the day the big banks stopped having lunch on me! They count on things like this to go wrong so they can kill the little people like us. Can't you see that? Its all a very cruel way of making money.

I've had more than my fair share of overdraft fees, but I can't think of any when a bank was retarded enough to charge an overdraft when the funds were deposited, but not processed yet. I would call their general customer service and immediately ask to speak with a supervisor. It is a bank error. You had the funds, you were simply waiting for the money to be released. They should treat you as such. I would also recommend changing banks as soon as you get this all squared away. We had pretty good luck with Wells Fargo, and we've been with Bank of America for almost 6 months now and so far it's the best banking experience we've had (although I'm a firm believer that there's no such thing as a good bank). If you are talking about a small bank, you are probably stuck with the charges. However, if you are dealing with a branch manager of a national (or at least regional) bank, then she is working for someone else. Ask for their number. If you are not the kind of person who frequently has this problem, they are more apt to be sympathetic about it. Explain the situation and also note that an inconvenience this large could keep you off track even through the next paycheck. Ask them to please consider it. They still may not, but asking is never a bad thing. If they are consistently uncooperative, I'd consider switching banks once I got the account straightened out. Excellent advice from BoardingJD. I am such a b!itch when it comes to things like that, I would demand the fees be overridden, then open another account elsewhere and leave $1.00 in the old account. That $1.00 balance reminds them of the business they lost with you and it cost them more than that for statements, etc.
They are SO wrong in doing this and more than that is the "we can't" line of bull I hear more and more of.
Do you have a dated receipt for when the check landed in their hands? Why was THIS paycheck not direct deposit?

The branch manager can override the fees, but he isn't going to do it without a fight. You need to firmly explain to him that because the money was held and you weren't notified that it was happening, you've been charged a lot of money. Tell him, FIRMLY but without yelling, that he has two options. He may either override the fees, or he may hand you the cash that is the balance of the account and you would be happy to take your money elsewhere. Chances are, you'll get your way. If not, you really SHOULD take your money elsewhere. Good luck!

is this from Bank of America?? i had this problem with them before there were pending transactions in my account and they held them and paid a check first so i would be charged for each item that was pending a $35 fee .. they held our paychecks because they said they were from out of state but it would have been nice of them to tell us that when we deposited them ... Jerks .. i dunno if there is anything you can do but it sucks ..sorry
