My wife was traveling in a hired limousine when a car went through a red light infront of them and the driver had to brake suddenly, my wife was sitting in the back of the limo when the driver stoppped she was sitting in the front! The next day she had some brusing and severe neck and shoulder pain she had visited hospital and has been told she has whip lash. My wife has also missed a week from work, does anyone know if we have a claim for personal injury against the limo company?

Just to add there were other people in the limo and there were no seatbelts.

The claim would be against the driver that caused the accident, not the limo company, I believe. So unless you got the details of the car that pulled out in front of her, I'd say no, you don't have a personal injury claim.

Its the car going through the red light that was in the wrong, not the limo driver. There is a law that states that all passengers have to have their seat belt on while travelling. I would, if I were your wife go to a solicitor to enquire about the legal side of what happened. Did you get the number plate of the vehicle that jumped the red light, witnesses, were the police informed and the accident reported?

First of all look and see if your house insurance covers you for legal expenses - you pay a small extra premium for this. Then phone up your insurers if you are covered and ask their advice. They will probably confirm if they think you have a case and have a list of approved personal injury lawyers they work with for you to chose from. If you don't have a legal expenses cover look for a reputable no win no fee PERSONAL INJURY LAWYER in Yellow Pages or check out the Law Society website and make an appointment to go and see them for further advice. Did the driver get the number of the vehicle that drove through the red lights. Have you kept all the details of the company in whose vehicle your wife was passenger and times etc and dates of hospital attendance. Hope this helps.

I assume that the limo company has some kind of form/contract that you have to fill out and sign (or the company who is paying for the limo) that would have the details of what they are liable for. I would see if you could obtain this document.
I would also suggest that you call a lawyer and see if you can get some kind of cheap consultation to see if you have a case or not. They will probably want you to go a specific doctor they normally use and it might better to do that sooner than later.

I would say yes as she has been to the hospital and officially diagnosed with whiplash. Obviously the hard part may be proving that she was injured in the limo as the driver is the only witness I assume. You need to get a proffesional opinion on this but I think you have a good chance.

Would suggest you contact solicitor.
Not sure if limo's are required by law to have a seat belt for each passenger, but I should think they would, as a mini-bus requires them.
Solicitor should keep you right on this, and if seat belts are a requirement, then would assume you could claim from limo company.

Oh yes, big time, especially as the limo was breaking the law, no rear seat belts.
Just to shut her up, you could get them to cough up big.

Was your wife wearing a seatbelt? If she was you have grounds for complaint if not then the onus falls on herself for not taking the relevant safety precautions.

The simple answer would be yes, I am not going into all the legal ins and outs, it would take too long.
Contact a good solicitor.
Good luck.
