I just had a baby and am in the middle of a nasty divorce and am curious if anyone knows if you can change an infants last name to be mine and his? My husband would not want this but I do what does anyone think?

I ask because he never see's his child and I have another child not by him with my maiden name and thought since his father does not even have the balls to be in his life then me, my daughter and son could all have the same last name.

You can, but if the father's name is on the birth certificate then you usually have to get approval from him. At least that's the way it is where I live. I've had to do it before.

By your ? I can see why your divorce is nasty, you're doing to much now. What you are doing now is being vindictive, by changing the child's last name. The divorce is between you and your husband, right now you're running on emotions.Take a moment, sit back & ask yourself. Do I really want to go down this road, I mean the kid will ask what happened. Mommy & Daddy were not happy together anymore so we got a divorce. Ok but why did you have my last name changed, this is not a battle you want or should be having.

It depends on your states laws, but I think your ex has to agree. As far as I know, only if the baby is being adopted by another man. But check with the social security office. They will know more and can tell you for sure.

You can but to keep things copacetic, the baby's last name would be both of yours with a hyphen.

Why do woman have to put the kids in the middle??
Is it his kid? Then it should have his name!
