The Employee Handbook says,
VACATIONS: Regular full time employees who have been with the company for less than 8 years but more than one year, are entitled to 2 weeks paid vacation.

I NEED TO KNOW WHEN THE VACATION TIME IS ACTUALLY EARNED ACCORDING TO THE HANDBOOK, #1 or #2?

#1 You start earning your vacation in the 2nd year of employment. The 1st year is not counted. You will have earned 2 weeks paid vacation by the end of the 2nd year.
OR
#2 You start earning your vacation in the 1st year of employment. You have earned 2 weeks paid vacation and are entitled to take it after 1 year has been completed.

The handbook clearly states you are entitled to 2 weeks vacation after your first year of employment. There are no stipulations made as to when during the year you may take the vacation, so it is understood that the full two weeks or any part thereof may be taken any time after the first year of employment. Don't be mislead to think you are "accruing" you vacation during the first year, because it says nothing to that effect. You are getting a "lump sum" two week vacation the first day following your 1 year anniversary.

I reckon it would be #2. It is unlikely that you would get no paid leave after working for a full year. It is impossible to believe that any company would expect you to work for two years before being eligible for two weeks leave. State your case clearly and concisely tomorrow and don't get too emotional. Write down the precise details of what you want to say before you go in - such as when you started and how you have interpreted the information in the Employee Handbook. It might be a good idea to take copies of any documentation you have to prove when you started - such as payslips or bank statements that show wages paid to you. This isn't all that clear, but the implication is that you earn your holiday entitlement throughout your first year and that once that is completed you will be entitled to two weeks paid vacation each year at any point between then and the end of your eighth year. So, #2 I would say. Good luck!

I could only interpret that one way. Beginning the first day of your second year with the company, you will have, as they state, been with the company for one year-- So you are henceforth entitled to two weeks paid vacation.

So, #2 would be correct.

#2 is the closest. You earn the vaction through the first year of your employment, but are not entitled to it until one full year of employment has been completed. Therefore, if you left the company for any reason prior to completing 1 full year of employment, you are entitled to nothing.
