The Employee Handbook says,
VACATIONS: Regular full time employees who have been with the company for less than 8 years but more than one year, are entitled to 2 weeks paid vacation.

I NEED TO KNOW WHEN THE VACATION TIME IS ACTUALLY EARNED ACCORDING TO THE HANDBOOK, #1 or #2?

#1 You start earning your vacation in the 2nd year of employment. The 1st year is not counted. You will have earned 2 weeks paid vacation by the end of the 2nd year.
OR
#2 You start earning your vacation in the 1st year of employment. You have earned 2 weeks paid vacation and are entitled to take it after 1 year has been completed.

AFTER COMPLETING one full year you HAVE earned the vacation.So the answer is number two in plain english.

I'd say, going on any company that I have ever worked for, you accrue your vacation time in the first year. On your one year anniversary you are entitled to your vacation time. Which would mean after 366 days employed by the same company, you could put in for 2 weeks off.

It is No. 2. You have an argument because the policy is vague and could be read either way. In such cases, the law generally reads the policy against the drafter (in this case your employer), so the policy will be read in your favor, which is No. 2. Make sure to tell the Labor Board that. #2, they have to pay you vacation pay for time worked. They can't make you work a year and give you absolutely no entitlement to vacation for it.
