Hi, i have sole custody of my son who now is 14 wishing to reside with his dad. I am allowing him his choice on a temp intermin basis. I was wondering what is the best way of words to change a private agreement, but to make it as legal binding contract. eg:should i ask for joint custody? He wants sole cusotdy and I am not ready to give him that as of yet. What are my other options? Any help is appreciated. thanks

There is no legal way of doing it without the courts ordering it.If you have joint custody right now then he can go live with dad.If you dont have joint custody then by law you have to go to court and you and his dad has to be in agreement to the child living with him and agree to joint custody.The courts will not permit the child going back and forth from moms to dads to live due to the fact that this child needs a stable home to live in.So if you give custody to dad then 6 months later you want your son back,chances are the court will say no.If he wants to live with dad and you get joint custody and visitation and you know dad will give him a clean loving home then do it.Oh keep in mind you will be order to pay child support but if you have been taking care of your son all this time then child support should not bother you.

I would advise not changing anything legally in the paperwork, once it is change you are unlikely to be able to change it back. You could allow son to live without the other parent for as long as you like without change the papers, then if it is not working your sin can come home with less fuss.

always better to have JOINT CUSTODY but have a CUSTODIAL PARENT ,, with whom the child spends the most time with,,

cuz if you croak, the state wont take your kids, until parental issues are taken care of, this way the other parent gets them right away
