Normally that is the way it is in the divorce. But check to make sure because some times it is for the entire period and not just the time of the marriage.

In most states the pension is split via a QDRO (Qualified Domestic Relations Order) and they only count the time you were actually living as man and wife. So if you have been married 10 years but separated 2, only the pension accrued during the 8 years will be counted and split.

It cannot be hidden, as the employer has charge of the accounts and IRS regulations apply.

Everything is negotiable. You can give up half of your pension in exchange for something else, or they could say they don't want any of it.

The important thing is full disclosure. If you hide it and its found you can lose it all later.
