If it is an invasion does the Geneva convention apply? Do the rules of war apply still?

No, war hasn't been "officially" declared, but that's not really an issue. It is basically agreed that if the Congress grants the president approval and funding for his use of the military, that is essentially their 'declaration of war'. I'm not sure if there are any special legal differences between the two - all rules and conventions apply in any case.

Per Geneva, signatory states are still expected to comply with all the rules. In our actions in Afghanistan and Iraq, we have complied with all the applicable rules.

Let us be clear - the Geneva protections on POWs were meant only for combatants who obeyed the Geneva conventions. This means that people who do not wear uniforms, who hide behind civilians, who specifically target civilians, who saw the heads off their captives, etc, are NOT protected. Their violations invalidate any protection they might be offered.

But WRT to the rest of the Geneva - no targeting of civilians, no use of banned weapons, treatment of captured uniformed enemies and enemy government officials, etc, etc, the US has been in complete compliance. Yes there have been instances of criminal acts by individuals, but these have been isolated instances and have been brought to prosecution.

Yes, war was officially declared by Congress.
Yes, the Geneva Convention applies, so long as the combatants are uniformed.

it was a illegal invasion of Iraq by u,s,a after the fact the u,s,a declared war on them,so what else is new,they are a free country now..unless bush decides to change the articles of war ,he agrees to play by Geneva's rules,for now...

An invasion since there was never a Declaration of War, written or signed in Congress. The rest above me are telling lies, and wont be able to produce one since there isn't one.
