It was a police officer and the vice-principal of the elementary school. They kept him for a little under an hour and threatened him with life in jail, because a child said that my son said he was going to shoot a neighbor. Once they spoke with another boy who was present for the conversation, they apologized to him and let him go. I was NEVER called. I only found out when my son got home from school.

it is legal but I would not appreciate agents questioning my son without me present or without my consent

Generally No
No because if it is a juvenile charged with a crime they have no idea of what there legal rights are. Miranda Rights.
Yes because it could have a life or death call that needs to be acted upon immediately.
ok now that I see your added comments. Yes I support that. They were trying to find out about a possible shooting. Please Remember Columbine, and all the other school shootings...
Now I do not agree with teh whole You are going to jail for life thing. That is BS but then again a mojority of interogation is a lie. But for a 12 year old that is a bit too much.

Anyone under the age of 18 needs to legally have a parent, guardian, legal professional or someone who can speak on their behalf when being interrogated. You didn't mention if the interrogation took place by the police or a neighbor who caught the kid doing something bad, for example.

you can sue the school as well as the police department. you are not aloud to interrigate a minor in that way with out a parent. but teach your child to say "im not saying anything till my parents are here: when they talk to the police at anytime. the only ones that can interrogate your child at school is the school and or social services.

are you an attorney? obviously not otherwise you would not be asking this question. in a perfect world they should have called you and informed you on what was going on so that you could call an attorney to be with your child during the interrogation. you wouldn't have helped the process at all because you do not know the types of questions that your child would have to answer. you would have gotten in the way and been disruptive.

It isn't acceptable. The school system and the police department will justify their actions but you can do something. A lawyer would be best because you have to be very persistant with these matters

No! A kid that young can be "lead" very easily into confessing things or saying things that are not true! If your child in office at school or is being questioned by any authority figures, be sure to tell them that they should only say "will you please call my mom/dad/guardian" and nothing else.

assume the kids got it wrong and someone was going to shoot you. much better to have a solid case at trial than to prevent a murder. is that what you are asking? "you need a license to drive a car, and you need a license to catch a fish but any moron like you can be a parent. all you need to do is drop your drawers. STOP THINKING!!!!!!!!!!!!!!
