Can anyone please help me. He cant go back home as his wife had a affair, should he be going to the hostel?

If they jointly own the house or are joint tenant's, of a lease property, council or otherwise, he is entitled to remain in the family home if he wants to do so or until he finds other accommodation or until the marriage breaks-up, if the case may be.

However, if his wife is refusing to let him come back he is regarded as being homeless and should contact his local authority (council) who can offer him emergency accommendation. His local authority should have an 'out of hours' service he can call, on the other hand he could find out about accommendation from charitable groups in his area.
He could maybe even find some cheap bed and breakfast place or try and find a relative or friend who could put him up for a couple of days until he gets himself sorted out.
He is best contacting a solicitor who will advise him of this situation and his legal rights. however, if the property is in her name alone, he will have more of a battle on his hands if he was to claim his share for the years they have been married together.
She is the one who should leave the home and not him...unless of course the home is in her name alone and she would be entitled to do whatever she wants in this sad situation.

I cant believe that I just read that question!!
Your mates wife has been kicked out of the family home because his wife is having an affair???
And he has gone, tail between legs and sulking a bit!!!
Just cant be true even the biggest wimp living wouldnt do that, what is it you arent telling us???
I suppose his wifes boyfriend has moved in????
I'm no macho man but even if the guy was 6'6" and built like a tank, i would get rid pretty quick, if I couldnt do it I would find some one who could, the guys life would not be worth living!!! Guess who would be the next on the list to depart??
That feels better now I've got that offf my chest!!! I enjoyed that!!!

It would seem that he should have done the kicking out.
She has no legal right to kick him out as the home is a joint asset. I suggest he gets back in there quickly, waits until she is out and change the locks. Then he can negotiate the terms of re-entry and/or divorce.

He cant go home why? Its is house..and its wife that's done the dirty.....tell him to be a man...and go home....if there is something that your'e not telling us then be a good friend and give him a couch for a while!

as a last resort, maybe, cant you let him stay with you till he sorts something out, or maybe some other family or friends. a hostel seems a bit extreme

helloooo if shes in the wrong then he has every right to go back there tell him to go back there and get all the stuff that hes payed for if she wants to be like that id take the carpets as well.or for the time being tell him go to his parents or let him stay ova at yours

it's not your problem...he will have to sort this out by himself...or like the others said....have him go back and kick her out...or better still put him up till he finds somewhere else...after all he is your mate..
