Not that I know of - and I don't understand what the point would be. Also, your attorney can't represent both of you - that's a conflict of interests. If she is saying that she can, I would look for a new attorney immediately b/c something isn't right with that.

Number one, you need a new attorney. I don't think an attorney can represent opposing parties in the same matter. Number 2, if he forced you to have sex with him, why would you care about him being arrested. Number 3, he's threatening you. Call the police, get a good lawyer. You do not want someone like that raising your son. At least have a file started so that if it comes down to custody, you'll have a history of what he has done to you. Good luck, I hope you figure this out.

First off, I have to question the validity of this question as it is COMPLETELY unethical for an attorney to represent both sides. If that is truly the case, get a new lawyer and do it now! Secondly, no there is no way to report a rape and not have an arrest made (in the US) because it becomes the DA's choice to prosecute, not the victims.

Do you know how many arrests were made in relation to the number of rape reports made?
I dont have the statistics.......but I can tell you the percentage of arrests after reports made is definitely less than 50%.........or may be even less than 20%.
The law requires that a rape has to be proven before it could be classified as rape.
In your case..........from what you said.........I think you are just a softie........n a hopeless useless woman....n no wonder u r getting divorced!

You can't have the same attorney. If he is paying for the attorney, its his attorney and you are representing yourself. See your own attorney before his coercion escalates.
