There is no reason whereby an amicable agreement isnt reached prior to divorce proceedings and the Financial settlement dealt with in advance. This can happen where there arent sufficient grounds for divorce, but you don't wish to hold up your lives all the same.

The only problem is if one of the parties later contests the agreement and the whole lot gets raked up again. Please bear in mind you do not need a solicitor to get divorced!

You don't have to get divorced, however, separations are only temporary and most courts will not allow them to continue without some sort of resolution in a timely fashion. Just make sure you separate through the court system and you get everything in writing so that it can't be contested at will.

I think it depends on which state you are in.....I would also think that you would have to do a "Legal Separation" where there was some form of court odered/monitor separation agreement
