I'm not sure I see the conflict. The US Constitution guarentees certain rights to US citizens from the US government. There is no territory involved and that is how it is enforced. The Patriot Act is inviolate of the Constitution, that's not a secret. It will either be repealed or the Constitution will be changed.

Everyone within our borders is bound by our laws, including constitutional, statutory & case law. If you are asking if non-citizens are guaranreed the same bill of rights protections as citizens, that's not so clear. IMHO it should depend on details.

The constitution is in effect in the United States. Iraq has its own constitution. We are serving in Iraq at the request of their elected government.

If you are refering to enemy combatants George Bush just set history by being the first world leader to protect the righs of enemy combatants. The Geneva Conventions do not protect them, not does any other treaty.

Citizenship is still based on land ownership. Though it has been extended beyond that. It is not Law only temporary permission.

With the legislation signed today -- and by the way one may blame Bush for this but congress wrote the bill and sent it to him to sign -- the constitution does much less for us at home than it did yesterday.
