For you the consumer the legality of on-line poker hasn't changed. However, there was a law recently passed as an amendment attached to a unrelated port security bill. They've tried unsuccessfully several times in the last few years to get the law passed on it's own merit so they had to sneak it through on a bill guaranteed to pass. Because on-line poker sites are physically located outside of the USA they are very difficult to prosecute so the new law imposes civil and criminal penalties on US based financial intuitions that process transactions between players and gambling sites. This has scared off some sites such as Party Poker and Pacific Poker but other sites are utilizing their legal resources and huge player base to try to get the law changed. In the mean time I suggest you put your playing dollars at the sites that have taken a stand. See link below for up to date list.

No it is not illegal to play online poker in the US. The legislation passed targets banks and the sites themselves. Some sites have pulled out of the US, some still allow US players saying that the law doesn't effect them. http://www.ultimatepokerbankroll.com/article.php/internet-gambling-ban-poker-sites-status their press releases and status is in that list, it should give you an idea of how each site plans to fight (or not fight) the legislation.
It's kinda sad since I've been playing through http://www.fortune-poker-rakeback.com for awhile now and now Americans aren't allowed on there anymore and I miss the Americans. But this other site Tony G Poker is which is cool.

It is illegal,it is not fair,it is not right,I am very upset,they actually went so far as to say there was the danger of kids gambling on line,Then ban the porn kids view it all day. this is not a credit card issue,I never used a credit card.This is a banking issue If
we had the money I sure don't and open a bank account in London you could play all you want. We are no longer free Americans with are living under a dictatorship.

No, it's not however you cannot place bets with your credit card. I am not sure if it only applies to states in which on-line betting is illegal or across the board. There is supposedly some type of money account that you can place money in to use for a specific purpose. You could always change your mind and use it for gambling.

It has ALWAYS been illegal. There just hasn't been any enforcement.
Instead, they're trying to make it more difficult to participate.
