so can like people get in trouble for downloading it n getting things off of it??

I depends what you download.

If you use it to download any copy-writed music, movies, and games, then yes, it is illegal. However, if you use it to download user-made movies, royalty-free & copy-write expired songs, and home made games, you wouldn't be breaking the law, since those things are free.

Here's 1 question which will help you determine whther or not an item is legal to download (works in 99% of the cases) :

Is the item you are downloading for sale in a store, or online?

If someone is selling it, it is extremely likely that is is copy-writed, therefore illegal to download.

the new bearshare is legal..if you notice when you download it and search for a song it asks you to buy it instead of just downloading it from a host

the old bearshare is illegal..you can get anything off of it including but not limited to security suites that would cost you around 60$ in the store

The SITE is legal, but sharing copyrighted programs, music and other stuff is illegal.

ive used bearshare before and alot of the stuff seemed illegal, but im pretty sure its all legal
