I had money stolen from my acount without my permission. I informed the bank of this and they told me the company who took the money. The two things I have been wondering since this happened are :
1. Will the company who stole my money get prosecuted, if so what is the likley sentence they will receive?
2. Will I get back the money that was taken from my account?

If any of you have had similar things happen to you in the past, can you tell me what happened, so that I know what to expect, thanks.

The money was taken totaly by fraud, i didn't have any previous dealings with the company.

i work for wells fargo, once you file a claim someone should contact you asking several questions... try to ask any questions you have at that point... i work in the fraud division just contact your back and you should be good

1. Depends on if the courts can reach the company---they can be evading the law. Sentencing depends on the state and the statute under which they are prosecuted...consult a local attorney.
2. Money taken from your account depends on your bank. If the courts are able to find the company, sue them for fraud (civil case) and sue for the amount of money they took and extra costs.

You must press charges and tell the bank that you will complain to your state banking commission if they don't take action. You file a complaint with the police, then depending upon the amount of money (less than $5000) you can go to small claims court. In any event, you should go there and speak with the prosecutor for advice. File a complaint with the state and the state will contact the bank.

I have had similar things happen, but Toyota helped us and we closed all our accounts at Wells Fargo Bank....I would talk to the district attorneys office. Is this just a mistake that will take the company a few weeks to straighten out or is it just totally fraudulent?

Read all correspondence you got from the company. YOu many have not read the fine print and may have actually authorized them to do so. Then file charges against the company that you think stole your money.

I hope you made a police report. The bank is responsible for the security of your money if you didn't authorize the withdrawal. If there is identity theft involved it's a different story but if not, I would hold the bank responsible.
