my boss recently partnered up and our office moved into the partners one. (law firm) the problem is that the partner smokes in the office, it is so gross, i have talked to my original boss and the partner about how unprofessional and disgusting it is but he still does it, i posted no smoking signs and no luck. i dont want to have to leave my job, but i plan on trying for another child within the next year and i am concerned. my hours are very flexible there and i would hate to start new. any advice to stop this guy?

i dont think it is legal to smoke at work in NYS any answers ?

New York state law § 1399-o. Smoking restrictions.

Smoking shall not be permitted and no person shall smoke in the following indoor areas:

1. Places of employment
(followed by others)

"Place of employment" means any indoor area or portion thereof under the control of an employer in which employees of the employer perform services, and shall include, but not be limited to, offices, school grounds, retail stores, banquet facilities, theaters etc. etc.

I would have no problem at all quitting that job. Your health is everything. I can't say if it's illegal. If it's his business, I guess he can do what he wants, but you'd have to check that one out perhaps with the other employees. Anywhere you go you are likely to be around things that will cause you to cough. Have you talked to your doctor about wearing a mask or something else that would help you? EDIT: He didn't have to tell you he smoked. When a person has a problem the burden is on them to ask if they have a health concern. Are there other employees? It seems he is far enough away from you now, to be OK. Only you know.

It is not legal to smoke in NYS but I can't see anything happening to change that in your situation. It must be terrible for you. Is there any other room in the building you can use for an office?

i believe there should be law in your ofice /city /state that is against smoking in the office but be discreet about it because if there isnt then you dont want to get into trouble. donot use a company computer also if it bothers you that much just ask him politely or leave whenever he lights up

Nope. We live in a free society. He's free to smoke and you're free to be mad about it.
