this goes on at least 4 to 6 times a month. Sometimes I hear wimpering coming from the house.

i would tell the police that ur neighbors keeps digging hole in their back yard at 3 im the morning and sometimes u hear wimpering coming from inside the house

There might be another explanation though... you said you heard whimpering. Is it animal noises that you hear? If it's animals... maybe he's one of those crazy people who keeps a billion animals in his house and not taking good care of them. But... why would he bury them in the middle of the night?
Honestly, I would call the police if my neighbor was doing that. Tell them it freaks you out, it happens every week, etc. I think they would want to check it out.
