I take private guitar lessons and my teacher told me that if I get him sick then he would sue me, I would guess for the number of days he couldn't work. Can he do that?

He cancelled my lesson last week because I showed up with a cold. I was fine with that but he mentioned suing me if he gets sick.

Either he was joking or you should get another teacher.

That having been said, assumption of the risk wouldn't be a great defense. However, proving proximate cause would be a heavy burden for anyone attempting such a case. Unless it were some rare, infectious disease, proving that you got it from A and not B or C would be very difficult.

He can try. But he will probably loose because of the Assumption of risk doctrine.[1]
Just because he SAID he would sue you, does not mean he did not assume the risk.

No. I don’t think any lawyer will work for this case. No lawyer would go to court for this. If he goes to court he will loose. Everyone get sick that is normal.
