I am looking for a law, ordinance, or town bylaw that is now on the books that can serve as a model for local legislation. This is for my town in the USA. All answers with information appreciated!

The only law I know has to do with the "Fair Housing Laws," specifically the requirement for "reasonable accomodation" for folks with disabilities. Seeing Eye dogs are the obvious, but if an animal is necessary for emotional/psychological reasons such as with folks who are clinically depressed, the landlord MUST accept the pet/pets. In these cases, I'm pretty sure the landlord CANNOT require a deposit or at least a per pet one. When I was looking for a rental place, I had three cats. Most apartments/landlords accept up to 2 pets. But, because getting rid of one of my cats would have significanty aggravated my depression, my landlord has to allow the 3 cats. Hope that helps. Oh, this was in the state of Virginia, but I'm pretty sure the "Fair Housing Laws" are at the Federal level. I had a great advocate at an organization in Charlottesville, Virginia called the Piedmont Housing Alliance. They have resources for such organizations all over the country.

I've never heard of any law that requires landlords to accept pets. It might be complicated because criteria would have to be set on breed and/or weight limits. Such a law would have to allow landlords to charge extra to make repairs and replace carpeting. I once had a landlord who tiled his rental units so he could have tenants with pets. He charged alittle extra per month which I didn't mind paying to have my sweet doggy with me. It was a good arrangement for the both of us.

There aren't any. Remember you are renting from them and if they elect not to accept pets then that is their perogative. You cannot force them to take pets. Some apartment complexes prefer not to have pets in the complex but for an additional $100 per month then allow the renter to have a pet but the renter has to sign a waiver stating they responsible for any damage caused by pets and are allowed to have a dog or cat.

I have never heard of a requirement for allowing pets, but most landlords will allow small pets even some larger with a signed pet agreement. Usually you will have to pay an additional $100-$200 deposit if they are allowed.

No. Pets are a luxury and therefore are not covered under these type of situations. A seeing eye dog or similar animal may fall under different rulings. Rental property is still private property and while discrimination against a person due to race or religion is illegal renters can use discretion. They do not have to rent to a person who smokes, has pets, children, etc.

There is no such law or ordinance. Since the landlord owns the building and property, he/she always gets to decide if pets are allowed or not.

I'd be surprised if any law like that ever got passed, and if it did, if it ever stood up to a legal challenge. Pet owners are not a protected class of citizens.

Two places who would know, though - there are national associatons for property managers and landlords - I don't recall what their names are, but I bet if any one has heard of such a law, they have.

Sorry no such law exists. A landlord can pretty much set any rule he wants when it comes to what you can and cannot have in an apartment, except race or sex of a person.

I can't imagine you will find anything about requiring landlords to accept pets, unless this is a pet required for handicapped purposes.
In that they may be required to allow the pet per federal laws.

My parents owned numerous apartments. The landlord can prohibit about anything they want from pets to the number of people who are permitted to live in the apartment. On apartment unit that they owned housed retirees. Because of that, they were permitted to say that no one with children were allowed to live there.
Laws vary from state to state, and sometimes from cities to cities.
