You must petition the courts for a name change. Since she is still a minor, you have responsiblity over her until she is 18, 21 in cases where she is still in school.

I changed my daughters name here in NY and it was quite simple, first you need to find the petition and order. File it with the court, serve it upon her father (even if he isn't in the picture he still has rights) and from there you will be given a court date and the judge will decide whether or not it is in the right mind of the child to do so.

A question that comes to mind is, why does she want to change her last name. Probably no ones business. In some states the Register of Deeds office would be the place to start. Contact your local office (usually located in the Court House).

You do not need a lawyer for this process...save yourself some money. I am not sure why she wants to change her name and it is none of my business but my husband adopted my son who's real dad abandoned him at age 2. All we had to do to change his name was go to the local Probate Court and get the paperwork...you then go in front of a judge and state your reasoning for a name change. If it is a legitimate request in the judge's eyes he will grant the request. Where she is a minor you will have to fill out the paperwork and present in front of the judge on her behalf....good luck.

She cannot change her last name, (since she is a minor) but you can have her name changed. You'll have to petition the court for a change of name, and you will have to have a valid reason for doing so. An attorney should be able to handle this for you for a reasonable fee.

If you are determined to do it yourself, ask your local Clerk of Court what forms you will need to provide.

First YOU should seek legal advice. Your daughter is not old enough to change her name by deed poll just yet and I think her father has a say in this. Why does she want to change it? Has he abandoned her? Either way, seek the legal path.
