We have no hugh obligations as far as credit cards,furniture or vehicles with payments. We are amicable about everything even the two boys. However, I am a college student in the state of Florida and am not working.We have been married for 17 years. He wants to move out and find his own place. My bills for the household expenses are around $2000 a month. What do yall think? He says he only wants to give me 250 a week. Remember he makes around 70K a year.

$250 a week sounds about right for 1 kid. My sister was married to a guy that made around $45-50K and he pays $150 a week. You will probably get $300-350 a week with 2 kids. Take it through court and it won't be up to him.
But you should get used to the idea that you are going to have to go to work, even if you are a student. You are not going to be able to get $2000 a month in child support. It won't happen.

Rule of thumb in most states (but not a law) is for two kids is 25% of the non-custodial parent's TAKE HOME - NOT GROSS pay. So if his take home pay is say 4500/month that is $1125/month child support - divided by 4 1/2 weeks a month is $250/week. His estimate is exactly what most courts would grant you....Get a job, or delay the divorce until you get your degree.

You better make sure you get spousal support to tide you over until you finish school and can work full-time.

It may make more financial sense (depending on how much longer you will be in school) to continue living together until you are out of school and employed. If not, BOTH of your standards of living are going to go down dramatically.

The fact that you are a student...he has to give you alimony for the lifestyle he provided for you. In addition, depending on how many children you have with him, you are entitled to 17%-32% of his income (double check with the family court in your state). If he leaves you can get him on abandonment....you should talk to a marriage counselor/divorce attorney to get some professional advise on how to handle a situation like this.

Go to a good lawyer you deserve child support and spousal support.Give him the things that mean the least.I have found a web site that has the workup sheet on it.http://www.myflorida.com/dor/childsupport/pdf/poz8.pdf this should give you a better idea.Dont let him bully you.Get a good lawyer and make it so that he has to pay for him in the decree.

It's not up to you or him to determine the amount of child support the court decides and every state is completely different. Many things are taken into consideration.

20% of his income is generally rule, so you can expect between $1000 and $1300 per month. You mentioned how much your household expenses are, remember child support is for the children not for you. You need to find someway to support yourself.
