Please don't add rude comments. Just any advice that you can give. I recently violated my probation w/ a new charge. It's a DUI misdmeanor. However, it is my 2nd in 10 yrs. I was not highly intoxicated either. Barely over the legal limit. what should I do? the last time I violated probation, I was sentanced to 60 in county, which I served 30. Will this time be worse? Is there a way around it? Or what? Prior to this probation, I've never been in legal trouble ( well the DUI 10 yrs. ago ). I haven't even got a speeding ticket........please help w/ advice

It will be worse this time. It always gets progressively worse with each new offence. Also I would advise against the "Barely over the legal limit" excuse in court, cause it won't fly, and it will only make you look un-repentant. Truth is, you can be way too impaired to drive even if you are under the legal limit. The best "around" this problem is straight through it. Take responsibility for you actions and accept the consequenses. It will make you stronger, and make others respect you. And by all means, stop drinking! (This is not legal advice from a lawyer, and should not be taken as such. I am not a lawyer. Just a citizen wishing to share my knowledge and experience)

i'm not sure what state you live in for each state the laws are different. in CT your 2nd offense within 10 years is 4 months in jail no if ands or buts. Did you get a vop? (violation of probation) if so that is charges in itself, which maybe you can beat with them reinstating your probation. I don't know if this will really help you or not b/c i'm not sure what state your from.

Not trying to be mean or rude, but you do the crime, you pay the price, you move on with life and don't screw up again.

You knew you were on probation and at least somewhat intoxicated and you still drove. You made a choice. You need to LEARN from your mistake. If you want to get around it, you will need a lawyer.

well of course it will be worse, to presumably to teach you a lesson about not driving under the influence of alcohol/drugs.whichever it was. if you must drink , do it at home or travel by taxi.if you keep going the way you are , being charged with dui.you will eventually be in gaol for three years plus. this is a fools game .pull yourself together and have a look at your behaviour .start living within the laws. you could kill someone driving under the influence, perhaps yourself or you would be in gaol for ten years plus .

you drink, you fall down, no problem. if you were barely over the limit and only got a misdemeanor.. it is now time to push the limits. time to blow a point 18 and and see if you can stay between the lines on the highway. try to keep it under 9 mph over the speed limit and see if you can avoid being pulled over. you can do it; i believe in you. what's another sixty days? i would be proud to drive on any highway with you. i will bring my kids and we won't buckle up. should be fun!!!

I like the "bjnljholl" answer and highly agree with him. Take responsibility for what happened and pray that it works out.
