well back to court tomorrow again for his contempt hearing ,...can anyone tell me what happens at theses hearings?

this is just to see why he didnt pay right and to give him another chance to pay

even though this is the second hearing he never showed for the first one neither did his attorney .,...this is for a custody case.

a man sueing a women whom raised the kids for 10 yrs on her own.,.i sued him finally for support then he sued me.

he was only giving me 5o a week the boys are teens now they need more things i did it for 10 yrs by my self

this is not a support hearing this is a custody contempt i paid my half of my home eval he didnt so that is why he is being held in contempt.

and john i have been the primary caretaker of my sons for 10 yrs with no help,.,so dont put me down

He will argue why he shouldn't be held in contempt, try to make it your fault. Don't worry about it, if he doesn't show again, judge will, or at least should, rule in your favor. Good luck!!!!

Simple, he will be first asked why he didn't show for the first hearing. Since this is ONLY a hearing on the contempt of court charge I doubt very much if anything regarding the custody hearing will be presented although it might in the order to save time. He may be assessed a fine or even be sentenced to serve time in jail on the charge. As far as financial support goes, that is usually assessed at 1/3 to 1/2 his salary depending on how many children and the circumstances. If he isn't making all that much to begin with then the 50 a week might be all you get...

I wish you luck. Custody cases are messy. The judge will only give him so many chances and if he continues to not show up for hearings, the judge will lose his patience and order him to pay. Of course there is a chance that he still won't pay and there will be more hearings and if you push it far enough he could see some jail time. I don't know what state you live in, but if the court orders child support and your ex has a job, you should be able to have it taken directly out of his paycheck.

More from him means less from you as I see it. If he's been good in paying, why wouldn't you have just talked to him on behalf of the kids. Instead of sueing... what did you expect him to do...? He has an obligation to himself to prtect his resources as you are doing with yours.... he's paying 50, you ask for a 100 he negotiates for 75.... or the courts work out a percentage... I suppose you'll sue him next year too? and the year after?

If the kids are teens, maybe they should consider a part-time job... it builds character and adds a little spending money. for the things they want. you and dad are responsible for the things they need. There is a difference.

Sweetie, take a seat and gather your strength, you are in for a looong ride with child support. The courts know that if they lock him up he can't pay so they hope that the threat of jail will force him to take care of his responsibility....which it usually doesn't. Good luck and keep pushing the issue!

contempt of court is a dog and pony show. the man will likely be given options to pay a certain amount or go to jail for a certain time. i am not sure why your local child support agency has let it go. maybe you have to talk to them and get them more involved in amount collected.
