i won an auction on ebay, and i got the item at a really low price! But, the seller emailed me a week later and said he wants to refund my money and relist the item so he can get a higher bid!! it's so unfair! can he do this? are there rules against this?

ok, well i'm a little scared to report him because the items were football cards (for my brother) and I'm afraid the seller is going to bend them or something. how would you handle this delicate situiation?!

No, No, No, No, No he CANNOT do that! When a seller lists an item on eBay, and a buyer bids for and wins that item, the seller and buyer have entered into a legal binding contract. Both members are expected to honor that contract. In accordance with that contract, the seller may not:

1. Fail to deliver an item for which payment was accepted.

2. Significantly misrepresent an item by not meeting the terms and item description outlined in the listing (like bend the cards).

3. Refuse to accept payment for an item at the end of a successful sale.

If he has refused to complete the sale and payment has not been sent or payment has been refunded, report the seller. Make sure to include a copy of the email documenting the seller's refusal to complete the sale with the full message text and complete email headers when making your report.

If he agrees to send the cards, but you receive them damaged then you should refer to the eBay ITEM NOT RECEIVED process. You will also find instructions to report the seller to eBay on this page as well.

Violations of this policy by a Seller may result in a range of actions, including:

• Listing cancellation
• Limits on account privileges
• Account suspension
• Forfeit of eBay fees on cancelled listings
• Loss of PowerSeller status
• Referral to Law Enforcement

Tell the seller that you read eBays rules regarding "Seller Non-Performance" and you suggest he read them before making any haste decisions.

Sellers are generally really nice but some are horrid, I bought a camera off ebay for £20 it wasn't top notch so I wasn't expecting much but it came broken, I contacted the seller and he said it was fine to send it back but I had to get it to him by Friday (this was on the Wednesday) or he wouldn't replace it. To return it by then I couldn't send it recorded delivary (I know I was a fool) so sent it normal, on saturday I emailed him and asked if he got it and he said no, I asked him on the Monday and still not, but he suggested if I had sent it recorded at least I could have tracked it, (I didn't tell him I hadn't) I reported him because I got no more contact from him and nothing was done because he hadn't broken any rules as he hadn't stated it his description 'full working order'. Hardly ever use ebay now, and only with sellers I have used before and trust.

Also, if you've already left positive feedback, you can go back and add a comment to it about what the seller did so others can know. You can't change it from positive though.

If he really wants the item back, tell him to take it up with eBay! That should be interesting.

Yes, a seller can do this. I bought several times at ebay and I red about this unfair rule. I hope that you’ll find a better seller for the same item.

Somehwere on Ebay are the rules written as to what sellers and buyers have to go by.

Also, you can email the Ebay-administrators (sp?) and tell them about this....they will take action if the seller is not handling this correctly! (and for what it's worth : I think the seller can't do this)

report the person to e-bay. when u place an item on e-bay and somebody bids on it this is a legal and binding contract. the problem is that the person can simply say the item was stolen or something happened to it. but u should report to e-bay so if it continues to happen they will ban him - the problem with this is he can open a new account under a different name.

I would certainly think so. That breaks all the rules of Ebay sellers. I would certainly report this to Ebay. Go to their page and you will find a place to report wrong doings.

No he can not. All bids are a legal binding contract.

Save the email.

Go to the home page of ebay and click on EBAY LIVE HELP and tell the representative. They will direct you to safeharbor security.

Don't forget to exercise your negative feedback right.

There are no rules against it...but most sellers won't actually admit that to the buyer....lol. They will just say something happened to the item, like it got damaged or it is no longer available or something like that. As long as he refunded your money, you really can't do anything except leave negative feedback...but he can still leave retaliatory negative feedback for you too.

No, he cannot. You won the auction fair & sqaure. Report him to e-bay as an unscrupulous seller.
