Had my car for 90 days, purchase from Carmax dealership, not the Pontiac delership currently doing my repair. First week the 2001 firebird had to have engine coils replaced from carmax. Then I complained about the transmission. Carmax told me they had it checked totally out that week, "just a tight tranny they said" and that it was fine. That was in week 3. Now my car is in the pontiac delearship shop and needs a rebuilt transmission. Can I get any money back? Its only been 90 days or so, and the Pontiac delership is saying that someone, presumably car max, has been in my tranny.

If you can prove the problem existed BEFORE the warranty was up then yes. All you have to prove is that the problem existed during the warranty period and that carmax did nothing to remedy the situation. I would say nothing to carmax about it, because all you are doing is giving them a chance to prepare a good story before hand. They will find out when they get served with court papers.

If your warranty hasn't expired, they MUST fix the problem, or pay for it. However, if the warranty has expired, Carmax would not be liable, unless you have their claim that the transmission is fine in writing. Unfortunate, yes, that things are that way. But, without hard proof that they refused to solve the problem, I'm afraid you're going to have a hard time getting them to do anything. I wish you the best though.
PS If you have to buy a transmission, buy a rebuilt one, NOT USED! A rebuilt transmission is as good as a new one and it has a warranty. Used trannys do not.

As long as you got a receipt that says they checked it and that it was good then you can. But I think if the tranny went out you should have taken it to them first?
