Guantanamo Bay is held in perpetuity through a lease agreement with a previous Cuban government. The US sends a check to Cuba each year, but Cuba no longer cashes it.
Since Cuba and the US are already hostile toward each other, it's difficult to raise futher problems between the two countries. However, in the aftermath of 9/11, Cuba did not really protest the establishment of the prison.

It was basically done there so that the detainees would not be on US soil and thus subject to US federal and state laws. Only military and geneva convention rules apply (if even those).
I'm sorry, I don't know if it caused problems with Cuba.

When the US freed Cuba from Spain in 1898, we leased the Guntamano Bay area from them.
