You're asking the wrong question.

You should report this to your insurance company immediately.

There's no law against groundless lawsuits, and I bet you'll be getting one soon.

Even if you're not at fault, do you really want to pay your own money to defend a groundless lawsuit?

Let your insurance company do what you pay them good money to do, provide you a defense against lawsuits arising from the use of your covered auto.

Whether they actually ever pay the claim or not is immaterial. It's not whether the claim has merit or not that is the deciding factor, it's how a JURY will decide it that counts.

So unless Ben Matlock or Perry Mason is a personal friend of yours, get your insurance carrier on notice ASAP.

Even if he is Jay walking the driver is held accountable. Unless there was no possible way that the driver could have known or have stopped in time to avoid hitting the idiot. but that would involve witnessess

in canada the pedestrian has the right of way , another case of dead right
