In this case in Georgia, what happens to debt amassed from an individual (not in joint name) when the individual can't/won't pay? On other words, can the Creditor go after the other spouse after the divorce?

i don't know if this will help, but in wisconsin, yes, the creditor can go after the spouse even if the debt was accrued by the other and the account was in an individual account, not joint....that's why most divorces, bankruptcy usually takes place!!! good luck

In Utah you are f-d on debts. Even if the other party is court ordered to remove your name, they can refuse and the creditors will come after you. In fact, as long as you are legally married here either party can open as many accounts as they want, put the other party as a financial supporter and the creditors will go after them even if that person had no idea that this account existed. It is all perfectly legal in this f-ed up state.

In the state of Utah where I currently live, any debt entered into during the marriage is considered joint marital debt. Regardless of who initiated the debt.

Everything should have been defined in your divorce papers. He takes the Visa debt, she takes the car and payments, etc. A creditor may come after you, but send a copy of the divorce decree to them.

If it was entered into outside or before the marriage, the individual is responsible; during the marriage, both are.
