I have a cousin that her husband recently left the state and left thier child with her. She is wondering if since he just up and left, if his parental rights will be terminated In the state of KY?

No she cant just terminate his parental rights cause he left her. Even moving out of state that doesnt constitute child abandonment, The child was left in the care of its mother and was not in anyway harmed or hurt. That's called getting a divorce and all of you who think she should get the kids automatically should consider the same if you decide to leave your wife or husband. Leaving is not child abandonment.

Yes they are right. All she has to do is hire a lawyer, it'll make
thing easier on her. He'll take care of the paper work. Do some
investigation on his where abouts to serve him with court papers.
Then all he has to do is sign the custody over to her since he's the one that walk out on them. The Judge should automatically
make him pay for child support. They'll give him a time limit to looklook for a job. Once he has a job he has to start paying and they will know when he gets a job. Even if you were to get temporary help from the Gov. until you get a job, they'll make him pay for every penny that they give you while they give you to support the children. (Well they do in Calif. I'm not sure in your State) But tell her not to worry ,if he walk out then he wants freedom. Fight for the kids all the way and let him be.

No. There would have to be significant evidence that he wanted to terminate his rights and his rights can't be terminated unless he consents or put the child in serious harm by leaving it. But if he refuses to pay child support or have a relationship to the child, he may consent to terminating his parental rights. But they can't be terminated w/out his knowledge.

She can have his rights terminated, but she has to file with the KY state attorney general.

There is probably a time limit as to how long he has to be gone before he surrenders his parental rights. There may be paperwork she needs to fill out and she can get more answers at the court house.

LISTEN HERE! ASK YOUR COUSIN NOT TO BE STUPID AND GO FIGHT FOR FULL CUSTODY OF THEIR CHILDREN. AND THAT SON OF A GUN WHO HAD THE GUTS TO ABANDON HIS OWN CHILDREN HAS TO PAY FOR CHILD SUPPORT. HIS PARENTAL RIGHTS WILL BE SET IN A COURT AND THEY MIGHT OR MIGHT NOT NE THE SAME AS IF HE WAS STILL WITH THEM. USE SOME LEGAL HELP THAT IN MOST CASES IS FREE FOR THESE TYPE OF CASES.

America is notoriously known for child abuse and child abandonment. I think you should ask your neighbor they sure are bound to know.
