Driving While Intoxicated is operating a motor vehicle with a blood alcohol level that equals or exceeds your particular state limits. Driving Under the Influence is when your blood alcohol level is below the legal limit, but your driving has been affected in the opinion of the officer who issues the ticket. That particular charge is an attempt to deal with persons who are not actually drunk, but whose driving ability was demonstrably hampered by the alcohol. DUI can also be used for persons driving under the influence of drugs which depress the nervous system- which is why you see the warnings on medications that will cause drowsiness or impaired ability to concentrate on tasks. If you take these drugs and drive, and they discover you were on medications or illegal drugs at the time, this is what you will be charged with.

DUI is Under the Influence and is a lesser charge than DWI. In most states, you can get a DUI with a BAC of .08 or less. Over that is a DWI.
A good analogy is being a little tipsy versus Drunk

The only differnce is the U and the W.
In California or West Coast, we use DUI, Driving Under Influence.
In New York or East Coast, they use DWI, Driving While Intoxicated.
There is your anwer. Every state has to be different for some reason...go figure..

DUI (driving under the influence) and can be drug related as well as alcohol related., while DWI (driving while intoxicated). DUI may just a small amount of alcohol or drugs, while DWI has a percentage attached to it. In Missouri, the legal limit is .08, which is approximately 2 beers or less.

Driving under the influence and Driving while intoxicated... DWIs are pretty much out... usually they only give out DUIs now because it means anything that impairs your driving

DWI usually pertains to persons that have been drinking alcoholic beverages. DUI can include drugs of any sort.
