Talk to the school and if it does not end. File a police report. Just make sure when you speak to the school you give them your complaint in writing. Keep documentation.
Then try to file a case against the school they are responsible for your child when he is in their care.Good luck I know this is hard for you. Do not let the school bully you into not taking action.

You could include more, like if you had went to the school about this problem yet, or if the 2nd grader is being bullied by the 5th grader, because the 2nd grader doesn't leave him alone. There could be many reasons, all of which does not explain your question. First go to the school about the problem, talk to the kids and their parents to find out what is going on, if still continues than go for legal action. Harrassing and few other charges should do nicely.

First of all, I think it is essential that you put both the school and the parent of the bully on notice that the actions against your child are inappropriate and that you demand that further incidents cease and desist. Once the school and the bully's parent have knowledge of the inappropriate behavior, they can be held accountable for future incidents if they fail to take appropriate action.

If the principal is not taking action, then you need to contact the school board immediately in writing and in person. You may also want to contact the police station and tell them the situation. They may send someone to the parents house with you to speak with the parents.
If nothing is done, then I would do as the above person said and sue the school and the parents.

It sounds to me like the 5th grader is a sturdy candidate for a destiny police officer. he's have been given all of the properly suited skills. Bullying smaller people than him. Sounds to me like he'd make a damn positive police officer.

You can legally have the Bully charged with assault. The authorities will take him/her in and then the courts will decide what to do. Usually just being charged scares the bully and also the parents to take notice and action

Also, sue the school board if you had no choice in what school your child would attend.
I would suggest you engage an attorney, and s he/she should send certified letters to them all, putting them on notice that the next communication on this matter will be service of a suit.

all you can do is contact the school. if they dont do anything about it, you can press charges against the school.
