It is not hard if the biological father is not around. Call the juvinelle court house. They give you some great information. He will need to fill out this form asking for legal custody of your child. Better yet to become a legal gurdian. You feel out a waiver to state you have no objection not to say you are giving up your right of your child. than you get a court date and done. That simple. As long as the real father is not around it should not be a problem.
You won't even need a lawyer.

I'm not trying to offend when I ask this, because this makes a big difference.... do you actually know who the biological father is? Does he know he has a child? If you know who it is, you have to get an adoption attorney (you have to do this either way). You have to post a legal notice in the paper if you don't know where he lives, giving him a fair chance at either relinquishing his parental rights or fighting for custody or denying paternity.
Anyway, get the adoption attorney, if you truely don't know who the biological father is, you are going to have to get a signed affidavit to say legally the identity of the father is unknown.
You are still going to have to go through the motions of adiption: court, court costs, attorney fees, etc. The process will be a lot faster though because only one person is adopting and they probably will not have to go through a background check to adopt (although this is still a possibility).
Good luck to you! You have a great husband for wanting to adopt your child and treat her like his own.

I do not practice in Illinois, but I can assure you that a court petition will be necessary. You will need to consult a local attorney to get all of the specifics.
Adoptions and termination of parental rights will generally require notice of the petition any hearings where the court might make any decisions. While this might be uncomfortable, you will probably need to disclose to the court the reasons that you do not know who the biological father is and/or show your efforts to give him notice of the hearing.
If you can prove to the satisfaction of the court that you have tried in good faith to comply with adoption requirements, you should be able to get the adoption approved.

you have to show just cause that there is no knowledge of a known father. you would have to advertise in the area where your daughter was conceived for (i believe) at 6 months in a well known public newspaper. contact anyone you may have slept with during the time you conceived and run a DNA test. Once this process is completed, you can then move forward with the county clerks office to finalize an adoption date.
take care. and your husband is a wonderful man to be doing this.

I'm guessing you meant that your current husband to adopt your biological child.
Well, you need to go to your court house to begin proper paperwork.
Then they will make you post something in one of your local newspapers that your husband wants to adopt the child and it gives the possible biological father to come forward before he loses all rights. All counties differ, it'll be in the 2- 5 week range to post this.
Then you'll have to finalize more paperwork, then it's done.
It's actually a simple process.
Good luck!

I want to adopt my husband to adopt my daughter?
Kinda strange question there...
Anywho, I'm not from IL, but i think the first thing you should do is speak to state family services agency. You really should find out who the father is b/c he will have to give up parental rights. Otherwise, this'll be a real sticky situation if you don't know who your baby daddy is.
