I back up the other answers. The answer is no. The GOOD news is that even though all the rules apply to you as a small business, the other rules of big business apply to you as well. For example, if you want a new set of golf clubs, just make sure win employee of the month that month. You are required to have an annual board meeting with your company. Hold it the annual meeting in Fiji.... Team training events are also popular. You can have those at a ball game or dinners out. All those rules apply and allow you to use them to your benefit.

Even small companies have to do certain postings, but depending on size, any given post might not apply to them. For example, FMLA only applies to companies with 50 or more employees within a particular radius, but the posting is still required for smaller companies who don't have to follow it.

Assuming this business is in the united states the answer is no exemption.
However, if the business has no employees and is not incorporated, it will not need to obtain an employer tax id number. Without employer tax id number, it only needs to file appropriate tax forms if it has profit or employees.
If business is required to obtain a tax id # it will have to file even with no activity.
