I've heard this RUMOR time and time again!
ONLY a family court judge can decide who the kids live with.
The judge MIGHT ask the child who he/she wants to be with,but the FINAL decision lies with the JUDGE.
PLEASE don't listen to these other answers that the "child decides";they are WRONG!!

The law allows for the child to make his/her feelings known to the court. It is then considered by the judge. When possible the courts prefer that the child be where he or she wants to be, however, keep in mind...only if it's in the childs best interest.
No matter how much a child wants to be with one parent or the other... the courts still decide the fitness of that parent as a custodial parent.
Usually the courts start considering the childs wishes at age 12 or so... the older they get the more it weighs in the courts decision.

Most states let the child decide at between 8 and 12 years of age.
But if he has been adopted you are going to have to get an attorney. There is no way for him to make the decision and have it formal except through the courts. You could check with your local Legal Aid. They might be able to help you, or at least give you the information you need.

If your child was adopted, no. If he was adopted either you signed away all parental rights, or they were all taken from you by the courts.
At 16 a child has a choice which parent to live with, however, that only includes those with legal parental rights.

a child can petition the court as can a parent but the court decides ( unless the parents are both guardians and they come to an agreement )
from what i can make out from your question - your child was adapted ? so you gave up or lost guardian status ? if so ONLY the court can decide until he is 18

WEll since he was adopted you aparently arnt his legal gardian. so first u need to get some custody and rights. then in my state when u are 14 u cn deside witch legal parent he or she wants to live with. I no this because i was in your sons shoes. my father took me when i was 4 monthes old to california and put me up for adoption now i am 15 and my mom wants to see me.She went to courts got hole costedy of me and now i live with her in a lot better home dont woory everthing will be fine just get a decent lawter how knows what they are doing. best of luck and i hope u find your son.

If he's been with the other family for 8-9 years without further action you are unlikely to have any luck what-so-ever.
You could probably has gotten legal aid but after so long I doubt you could contest it.

yes, any child can decide who they want to be with. especially if there's several children involved, they get to pick so they have a say so whether of not they want to be seperated from eachother (their brothers or sisters)
