My father-in-law was hurt at work. He got a chemical burn on his face and it caused a reaction that looks something like Lupus of the skin. His body rejects his skin. He will never work again, though he has had hope since the incident happened 3 yrs ago. What is he entitled to? He has a workman's comp lawyer right now because they were giving him hell about paying for his medications. They pay for his medical bills most of the time and he gets $300 a month. The doctors that workman's comp keep sending him to are telling him that he is entitled to a large lump sum of money and that he will never work again, but of coarse WC throws out that doc's advice and sends him to another. Should he find another lawyer? File for disability? or unemployment? Thanks

He should contact a personal injury lawyer who specializes in workplace accidents

he should do it right away because, depending on where you live, the statute of limitations could be 2 years from the date of the incident.

He will not get more then the workers comp payments unless there was some negligence on the part of the employer. so i can't tell you if he deserves a 'large sum of money' because you didn't tell us how the accident occurred

This is a hard question to answer without knowing where you live. In Texas, you cannot sue your employer for a personal injury if there is worker's compensation. That is the purpose of worker's compensation...to protect the employer. So, definitely contact a personal injury attorney in your state and find out the lives where you live. Keep in mind that if you can sue on a personal injury claim, worker's comp. probably has the right to recover all of the money they have paid out from any personal injury settlement your father-in-law might receive. At the very least, apply for disability.

If I were him I would forget workmans comp, find another lawyer and sue the crap out of the company for all they are worth. He probably would be able to get disability and unemployment on top of it. He should get another lawyer that could get him everything he deserves. I mean, he can't ever work again because of this company.

whilst the comp docs say you're healed your criminal expert will deliver you to a doctor for yet another assessment. Then there may well be a mediation for a freelance. If particularly you have an criminal expert. If no longer, get one. you will be eligible for damages if there's a share of incapacity whether you come to paintings doing the comparable activity.

gold mine and a moron first off he should be receiving 2/3 of his salary tax free...unless his salary was about a hundred bucks a week.....you are allowed to go to any doctor you wish. if you use their doctors and they say you can't work is the very best situation you could have. you and your lawyer are morons...

he can file for disabilty and that takes awhile to process..he should find another lawyer is the one he has does not file for him, he should recieve a lump sum for his accident...
