He has no papers to be here in the USA and also has two D.U.I's

We are going through a divorce and he has hired a lawyer .. Is that allowed being that he has no rights to be in the USA?

we were filing for his papers and my immagration lawyer told me that I had to cancel his papers cuz I'm the one who only has the right to give him papers...and no he is not legal cuz we were married it doesn't work that way anymore

ok you guys are acting like personal property is the issue...no.....I'm talking about the custody of our children...I'm not the one who left he did and I'm emotional you don't have to treat me like I'm heartless....He has done more bad things to me and until you can understand that plz don't deam me the bad one

The heck with all these answers. The number one thing is to take care of the kids no matter what as harsh as this all may seem. He is illegal hence if you get him deported he will have zero rights. Sure you loved him once upon a time but again its about the kids. And just because he married you doesnt mean he got residency in the US, its a process. Actually the marriage is most likely not valid so you retain custody no matter what.

It is hard to determine his entitlement due to the fact that he is an illegal alien, but being that the two of you are legally married then regardless of his status. As far as the rest of the things here that people are saying about deportation, etc. don't be a hard ***. At some point you loved him enough to marry him, and knowing what hard working men many of the illegal Hispanics can be, I am sure (even despite his 2 DUIs) that most of what you aquired was bought with money that he earned. I am not saying give him everything, but don't screw him over just because your marriage didn't work out. If you do, it makes you no better than those people that stared and whispered behind your back for marrying him in the first place.

If he was married to you and lived in the US for 1 year...he is now a US citizen..i don't believe he needs papers at this point. does he have a Social Security number? I think you need to ask a lawyer ...not this crowd.

If you do not have an attorney, or can't afford one...turn him in to ICE.. call your local police, and get him out. If he we're legal, I would say YES, he is entitled..I LOVE legals, but want illegals to stop coming into out country and abusing the system. Looks like he abused you, although it may not be physical...CALL THE POLICE. They'll handle it from here. And don't wait another second...GOOD LUCK, and stay safe...

I don't think residential legality affects divorce law.
You might both be living in France and get divorced, but the law relates to the country in which your marriage was registereed.

When you married him, he was then a legal permanent resident. Yes, he is entitled to half of what you accumulated together as husband and wife (community property).

If he has nothing in his name then nothing is his, because even if you were to give him the house you need a ss# to out on the documents, and light bills etc. So no I think him even thinking of asking for stuff will open a can of worms for him and trust me it's a can thats hard to climb out of..

If he lowered himself to marrying you, then he is a citizen if you are. He is entitled to half of the marriage assets. Maybe if you weren't such a vindictive B***h he wouldn't have had to drink so much.

Probably just US Citizenship. You did marry a alien and by doing that it gives them citizenship; Anything else is depending on how long you were married to him. Inculding anything you have under both names.

if he is an alien, i dont think you could have legally married him..... but dont listen to me. find out for yourself. call a lawyer. you could call the nearest college and thier student lawyers will probably help you out for the experience. hope i helped. sorry you 2 didnt work out.
