I work for a company in california... My employer has changed the way they pay overtime... for example if I start a job 6pm and dont get off until 4am... i use to get 8 hours regular pay and 2 hours of overtime... now they are saying that a new day starts at midnight so the overtime doesnt count so i get 10 hours of regular pay... does this sound right

The standards are spellout in U,S, Wage and Hour Laws. Most States mirror these inthier own laws.

That standard sets the 40 hour work week. They could work you 24 hours a day for a day and half or so a week. As long as you don't go over 40 for the week, no OT. They do have to set their work week and can't keep changing that around in order to avoid paying OT.

If the way they used to do it has changed I can understand your concern but it is right so far as ten hours is concerned. They must pay you overtime only if you work beyond 40 total hours per week.

Overtime is generally defined as working more then 40 hours a week. So you do the math.

The law says that overtime is any amount over 40 hours per work week. Any other computation is negotiable/contracted for.

Anything over 40 hours per work-week is overtime by law.
Anything under that 40 hours per week is not.

There could have been a genuine mistake with the hours. Ask your employer, respectfully, if your hours could be checked as you think there might have been a mistake. Don't go barging in making a fuss or you might end up with egg on your face.
