Like if someone was burglarizing your apartment?

I have no idea, I heard this in a debate once and wondered which con-loving POS would allow this. I'd much rather put a bullet through the burglar's head. Or something less harsh....

But seriously, why do many extremo-Dem's like to preach that we're wasting resources, yet allow people like this to live on? Do they really deserve to live?

What this is is the "duty to retreat"--in some states (mostly in the East) and homeowner(or legal resident) must exit or move back before using deadly force if he/she can do so safely.

In other states (mostly the South and West) there is no such duty before deadly force can be used but the homeowner must still be in reasonable fear for their life.

I agree with your sentiments.

If I lived in New York, I wouldn't give a s**t about that law, you break into my property you're going down. This is the type of behaviour we get from the Dems, helping the 'misunderstood' criminals. If this is really a law (which I pray it isn't), then all burglars will be heading to NY. Wonder what their burglary rate is compared to the rest of the nation?

Without addressing the political commentary or questions, the correct answer is that there is no such law in New York. That having been said, there is also misinformation above with reference to when use of deadly force is permissible.

If you keep a weapon for self defense, you should make sure that you are well aware of the law in New York (or your state) as to the circumstances under which use of the weapon is permitted.

Defense of property allows a person to injure or even kill a person who has trespassed or is commiting damage to his property. This a valid defense under the Criminal Law.

This is called "a duty to retreat" and no there is no law requiering a home owner, bussiness owner, or lawful renter of a home, and or bussiness to surrender his/her property to a tresspasser.

no. if a person enters you premisses unlawfully you have the right to blast em. as long as they are not running away from you. if they run then you are no longer in danger and don't have the right to shoot.
